LINK Swears!!!!

CHARLESTON -- A district court judge has stopped work at several Fola Coal Co. valley fills in Clay County but will allow the company to continue other operations to stay in business at least until the company's valley fills trial ends.
The preliminary injunction was granted for Fola Ike Fork No. 1 and No. 2 Surface Mines, but Judge Robert C. Chambers, for the U.S. District Court for the Southern District of West Virginia, suspended the decision for valley fills 2 and 3 on the Ike Fork 1 permit.
Fola Coal lawyers said during the preliminary injunction hearing that the company would be forced to close unless it received a stay allowing certain valley fills to continue during trial. Fola Coal Co. is a subsidiary of Consol Energy and employs 350-400 employees.
Company lawyers said during the preliminary injunction motion hearing Oct. 22 that Fola Coal is the largest private company in Clay County, and the county depends on taxes levied against the company for half of its budget.
In testimony, Clay County Commissioner Jerry Linkinogger said that direct taxes and severance taxes from Fola Coal comprise about 65 percent of the county's budget.
